This Service and Usage Agreement (“Agreement”) governs the use of all products and services (“Services”) provided by Fog Hosting Limited (“Fog Hosting,” “we,” “us,” or “our”) to any individual or entity (“Client,” “Customer,” or “you”).
By registering an account, purchasing, or using any of our Services, you agree to be bound by this Agreement, as well as all related policies referenced herein, including our Privacy Policy, Refund Policy, and Acceptable Use Policy (AUP).
Fog Hosting Limited is incorporated under the laws of the United Kingdom, and operates globally with data centers and business operations in the United States, Bangladesh, and other international regions.
Fog Hosting Limited provides a range of IT and hosting services, including but not limited to:
Shared Web Hosting
Reseller Hosting
Virtual Private Servers (VPS)
Dedicated Servers
Cloud Hosting Solutions
Domain Name Registration and Management
SSL Certificates and Security Services
Managed Hosting and IT Consultancy
All services are provided subject to this Agreement and may include specific service-level terms.
3.1. To use our Services, you must create an account by providing accurate, complete, and up-to-date information.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3. You must be at least 18 years old or of legal age in your jurisdiction to enter into this Agreement.
4.1. Clients shall not use Fog Hosting services for any illegal, abusive, or unethical purpose, including but not limited to:
Hosting or distributing malware, spam, or phishing content
Engaging in denial-of-service (DDoS) attacks
Storing or distributing copyrighted material without authorization
Promoting hate speech, violence, or discrimination
Running cryptocurrency mining without explicit permission
4.2. Fog Hosting reserves the right to suspend or terminate any account found in violation of the AUP without prior notice.
4.3. Clients are responsible for the content hosted on their servers, websites, and applications.
5.1. All fees are due in advance unless otherwise stated.
5.2. Fog Hosting accepts payments via Credit/Debit Card, PayPal, Bank Transfer, bKash, and Cryptocurrency (where permitted).
5.3. Service renewals are billed automatically prior to the renewal date.
5.4. Accounts not renewed by the due date may be suspended or terminated without further notice.
5.5. Clients are responsible for keeping payment information up to date to avoid service interruption.
6.1. Fog Hosting offers a 30-day money-back guarantee for shared and VPS hosting services.
6.2. Dedicated servers, domain registrations, SSL certificates, and custom IT solutions are non-refundable once activated or delivered.
6.3. Refund requests must be submitted through the client portal or in writing to billing@foghosting.com within the applicable refund period.
6.4. Refunds are processed only to the original payment source and may take up to 10 business days.
7.1. Fog Hosting guarantees 99.9% uptime across all hosting services, excluding scheduled maintenance and events beyond our control.
7.2. Scheduled maintenance will be announced in advance via email or client portal notifications.
7.3. In the event of downtime caused by Fog Hosting’s infrastructure, eligible clients may request service credits, as outlined in our SLA (Service Level Agreement).
8.1. While Fog Hosting performs regular backups, clients are solely responsible for maintaining their own data backups.
8.2. Fog Hosting is not liable for any data loss, corruption, or unauthorized access resulting from user negligence, malware, or third-party actions.
8.3. Clients must maintain secure passwords, update software regularly, and implement necessary security measures.
9.1. Fog Hosting reserves the right to suspend or terminate any service immediately if:
Payment is overdue,
The account violates the AUP,
Fraudulent or abusive behavior is detected, or
Requested by law enforcement authorities.
9.2. Terminated accounts may have their data deleted permanently after 7 days.
9.3. Clients may cancel their service at any time via the client portal. Cancellation requests must be submitted at least 48 hours before the next billing cycle.
10.1. Fog Hosting shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services.
10.2. Our total liability, under any circumstances, shall not exceed the total amount paid by the client for the service during the last 12 months.
10.3. Fog Hosting is not responsible for damages caused by third-party software, user error, or external network issues.
11.1. Fog Hosting complies with applicable data protection and privacy laws, including the UK GDPR and international privacy standards.
11.2. Personal data collected from clients will only be used to provide and improve our services.
11.3. We do not sell or share customer information with third parties, except as required by law.

12.1. Fog Hosting reserves the right to modify or update this Agreement at any time without prior notice.
12.2. Updated terms will be posted on our official website at https://www.foghosting.com, and continued use of services after updates constitutes acceptance.
13.1. This Agreement is governed by the laws of the United Kingdom, and where applicable, the United States and Bangladesh, depending on the client’s region.
13.2. In the event of a dispute, both parties agree to first attempt resolution through mediation or customer support before pursuing legal action.
13.3. Legal proceedings shall be subject to the jurisdiction of the courts of London, UK, unless otherwise required by local law.

This Personal Data and General Confidentiality Agreement (“Agreement”) is established between Fog Hosting Limited (“Company”, “we”, “us”, or “our”) and the Client, Partner, Employee, or Contractor (“you” or “your”).
The purpose of this Agreement is to ensure that all personal data, confidential business information, and client data handled by Fog Hosting Limited are protected, processed lawfully, and kept strictly confidential in compliance with UK GDPR, Data Protection Act 2018, and applicable international privacy laws.
“Personal Data” – Any information relating to an identified or identifiable individual, including name, contact information, IP address, or other unique identifiers.
“Processing” – Any operation performed on personal data, such as collection, storage, use, transfer, or deletion.
“Confidential Information” – Any data, document, or material (written, verbal, or digital) shared by Fog Hosting Limited or its clients that is not publicly available.

6.3. Backups containing personal data are automatically overwritten and destroyed following scheduled retention cycles.
7.1. Fog Hosting does not sell or rent customer data to third parties.
7.2. Personal data may be shared only with trusted third-party service providers (such as payment gateways, registrars, or compliance partners) solely for operational purposes.
7.3. All third parties handling data on behalf of Fog Hosting Limited are bound by confidentiality and data protection agreements ensuring compliance with GDPR and equivalent global standards.
7.4. International data transfers are conducted only under legally approved frameworks such as Standard Contractual Clauses (SCCs) or adequate protection regulations.
8.1. You must handle all confidential and personal data responsibly and comply with this Agreement at all times.
8.2. You shall not attempt to access data or systems beyond your authorized scope.
8.3. In case of any accidental or unauthorized disclosure, you must immediately notify Fog Hosting’s Data Protection Officer (DPO).
8.4. Employees must securely log out of systems and protect credentials when leaving workstations unattended.
In compliance with GDPR and global privacy standards, clients and users have the right to:

Request a copy of their stored data (Data Portability)

10.1. Any breach of this Agreement, whether intentional or accidental, may result in disciplinary action, service suspension, legal proceedings, or termination of employment or contract.
10.2. Fog Hosting Limited reserves the right to seek damages and injunctive relief to protect its interests and those of its clients.
This Agreement shall be governed by and construed under the laws of the United Kingdom, with applicable extensions to the United States and Bangladesh for clients or partners based in those regions.
Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of London, UK, unless otherwise required by law.
