Effective Date: Upon Service Activation or Employment Commencement
This Personal Data and General Confidentiality Agreement (“Agreement”) is established between Fog Hosting Limited (“Company”, “we”, “us”, or “our”) and the Client, Partner, Employee, or Contractor (“you” or “your”).
The purpose of this Agreement is to ensure that all personal data, confidential business information, and client data handled by Fog Hosting Limited are protected, processed lawfully, and kept strictly confidential in compliance with UK GDPR, Data Protection Act 2018, and applicable international privacy laws.
“Personal Data” – Any information relating to an identified or identifiable individual, including name, contact information, IP address, or other unique identifiers.
“Processing” – Any operation performed on personal data, such as collection, storage, use, transfer, or deletion.
“Confidential Information” – Any data, document, or material (written, verbal, or digital) shared by Fog Hosting Limited or its clients that is not publicly available.
“Data Subject” – The individual to whom personal data belongs.
“Third Party” – Any external organization or person other than the data subject, the controller, or the processor.
3.1. You agree to maintain strict confidentiality of all data, trade secrets, intellectual property, technical information, client details, or internal documents that you access while using or working with Fog Hosting Limited.
3.2. You shall not disclose, share, sell, copy, or reproduce any confidential information without written consent from Fog Hosting Limited.
3.3. Confidential information may only be used for the purpose of delivering or managing the agreed services and shall not be used for personal or third-party gain.
3.4. You must take all reasonable security precautions (password protection, secure storage, encrypted transmission, etc.) to safeguard confidential data from unauthorized access or disclosure.
3.5. This confidentiality obligation continues indefinitely, even after your contract or service period with Fog Hosting Limited ends.
4.1. Fog Hosting Limited collects personal data solely for purposes directly related to service delivery, account management, billing, and customer communication.
4.2. Personal data may include, but is not limited to:
Full name, address, and contact details
Email and account login information
Billing and payment information
Server logs, IP addresses, and service usage details
4.3. Data collected will be used only for legitimate business purposes, such as:
Account verification and authentication
Providing technical support and service notifications
Processing payments and renewals
Enhancing service performance and security
5.1. Fog Hosting Limited implements technical and organizational measures to protect personal data against accidental loss, alteration, disclosure, or unauthorized access.
5.2. Data is stored securely in Fog Hosting’s data centers located in the United States, Europe, and Asia, under advanced encryption and restricted access controls.
5.3. Employees and contractors of Fog Hosting Limited are bound by this Agreement and are trained in data protection best practices.
5.4. If a data breach occurs, Fog Hosting will notify affected parties and relevant authorities within 72 hours, in accordance with applicable law.
6.1. Personal data is retained only as long as necessary to provide the requested service, meet legal requirements, or fulfill accounting obligations.
6.2. Upon account termination or contract completion, personal data will be securely deleted or anonymized within a reasonable timeframe (typically 60 days), unless otherwise required by law.
6.3. Backups containing personal data are automatically overwritten and destroyed following scheduled retention cycles.
7.1. Fog Hosting does not sell or rent customer data to third parties.
7.2. Personal data may be shared only with trusted third-party service providers (such as payment gateways, registrars, or compliance partners) solely for operational purposes.
7.3. All third parties handling data on behalf of Fog Hosting Limited are bound by confidentiality and data protection agreements ensuring compliance with GDPR and equivalent global standards.
7.4. International data transfers are conducted only under legally approved frameworks such as Standard Contractual Clauses (SCCs) or adequate protection regulations.
8.1. You must handle all confidential and personal data responsibly and comply with this Agreement at all times.
8.2. You shall not attempt to access data or systems beyond your authorized scope.
8.3. In case of any accidental or unauthorized disclosure, you must immediately notify Fog Hosting’s Data Protection Officer (DPO).
8.4. Employees must securely log out of systems and protect credentials when leaving workstations unattended.
In compliance with GDPR and global privacy standards, clients and users have the right to:
Access their personal data
Request corrections or updates
Request deletion (“Right to be Forgotten”)
Object to data processing for marketing
Request a copy of their stored data (Data Portability)

10.1. Any breach of this Agreement, whether intentional or accidental, may result in disciplinary action, service suspension, legal proceedings, or termination of employment or contract.
10.2. Fog Hosting Limited reserves the right to seek damages and injunctive relief to protect its interests and those of its clients.
This Agreement shall be governed by and construed under the laws of the United Kingdom, with applicable extensions to the United States and Bangladesh for clients or partners based in those regions.
Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of London, UK, unless otherwise required by law.

By using Fog Hosting Limited’s services, entering into employment, or handling any data or confidential materials related to the Company, you acknowledge that you have read, understood, and agreed to this Personal Data and General Confidentiality Agreement.
